International Custody

Western Kentucky International Custody Lawyers

Custody matters become exponentially more complicated when they span across international borders. Whether you or your former spouse is planning to take your child out of the country, an attorney with experience in international custody matters can help you achieve a favorable outcome. At Hopson & Parris, our family law attorneys have extensive experience regarding international custody issues.

The Hague Convention

The Hague Convention is an agreement between nations to enforce the custody orders of other countries. If a parent takes a child to another country without the permission of the court, this is considered abduction. Countries who have signed on to the Hague Convention agree to return the child to his or her nation of origin. Our attorneys assist with finding counsel overseas who can work with us to locate and return abducted children.

Not all countries have signed on to the Hague Convention. If the child is taken to a country that is not a signatory to the Hague Convention, returning the child is more difficult. However, it is not impossible. Our lawyers will take aggressive steps to ensure that the child is returned to American soil.

Prevent Abduction

We encourage our clients to take proactive steps to prevent abduction. Understand the risks before you agree to allow your former spouse to take your child out of the country. Our attorneys will advise you to take the appropriate steps to safeguard your child from abduction.

If you are planning to take your child out of the country, there are steps you can take to make the child’s other parent feel more comfortable. We will assist with the proper court orders and documentation for child relocation.
